Terms of use

The rules for using NorminUp, on every plan, the free one included.

This English version is a translation provided for convenience. The French version is the one that applies.

Purpose

These terms govern the use of the norminup.com website and of the NorminUp service. Creating an account means accepting their current version.

The free plan is open to everyone. Paid plans are for businesses only and are also governed by the terms of sale.

Your account

  • The information given at sign-up must be accurate.
  • You are responsible for your password and for what is done from your account. Two-factor authentication is recommended.
  • Let us know at contact@norminup.com if you think someone else has used your account.

What you may monitor

You may only monitor services that belong to you, or that you have the right to monitor. It is forbidden:

  • to use checks to attack, overload or probe someone else’s system;
  • to get around your plan’s limits, for example by creating several accounts;
  • to publish on a status page content that is unlawful, misleading, or that impersonates another service;
  • to disrupt NorminUp or try to access another customer’s data.

Suspension

If these rules are broken, NorminUp may suspend the services involved or the account. You are warned by e-mail first, except in an emergency, such as an ongoing attack launched from your checks.

Your content

Your services, incidents and status pages remain yours. You allow NorminUp to store and display them, only to run the service.

Your subscribers’ data

When your status pages collect their subscribers’ e-mail addresses, you are the controller of that processing and NorminUp is your processor within the meaning of article 28 of the GDPR. NorminUp undertakes to:

  • process this data only to send the notifications you configure, on your instructions;
  • keep it confidential and protected, as described in the privacy policy;
  • only use the providers listed in that policy, and warn you before adding one;
  • help you answer your subscribers’ requests; they can unsubscribe in one click;
  • notify you without delay of a data breach that concerns them;
  • delete it along with your organization;
  • give you the information needed to show these obligations are met.

Likewise, when you set a Google Analytics ID on a page, NorminUp collects its visitors’ consent on your behalf before loading the tool (see the cookie policy). You remain responsible for this audience measurement and for your relationship with Google.

Availability

NorminUp is provided as is. Everything is done to keep it running without interruption, with no guarantee that there will never be one. Maintenance is announced in advance whenever possible.

The status of NorminUp itself is public at status.norminup.com.

Liability

NorminUp warns you when a service goes down, but does not replace your own vigilance: an alert can arrive late or not at all, for example if the alert channel you chose is down itself.

NorminUp cannot be held liable for indirect damage suffered by the customer, such as lost revenue, customers or data.

Deleting your account

You can delete your account at any time from your profile, with your password. An organization where you are the only member is then deleted with everything in it, and its subscription is cancelled on the spot, with no refund of the current period. In a shared organization you leave it; if you are its only owner, make another member owner first. Invoices are kept for 10 years, as French law requires.

Changes to these terms

These terms may change. A significant change is announced by e-mail before it takes effect; continuing to use NorminUp afterwards means accepting it.

Governing law

These terms are governed by French law. In case of a dispute, an amicable solution is sought first; failing that, the French courts have jurisdiction.
